Abstract

Prometne nesreće vjerni su pratioci motorizacije cestovnog prometa, stoga sigurno stoji tvrdnja da je problematika istraživanja cestovnih prometnih nesreća stara koliko i cestovni promet. U slučaju prometnih nesreća i sudskih postupaka prikupljeni materijalni dokazi na mjestu nesreće i iskazi svjedoka prilikom očevida od presudne su važnosti za rješavanje i analizu uzroka prometnih nesreća. Temeljem ovih dokaza utvrđuje se odgovornost sudionika u prometnoj nesreći. Kvalitetno obavljen očevid uvelike olakšava daljnji tijek otkrivanja uzroka prometne nesreće i pridonosi rješavanju slučaja. Prikupljene činjenice su dokazni materijal prometno-tehničkim vještacima za izradu nalaza i mišljenja o prometnoj nesreći. Svako izvješće prometno-tehničkog vještaka mora sadržavati uvodni dio, nalaz, mišljenje i zaključak. Izrada svih dokumenata počiva na prikupljanju dokaza, preciznom mjerenju što zahtjeva fiksiranje tragova i određivanje točne lokacije predmeta u prostoru, te fotografiranje i prenošenje slika u određeni programski alat u svrhu obrade video dokumentacije. U radu je dan prikaz načina prikupljanja činjenica na kojima se temelji konačan sud o krivnji, odnosno odgovornosti za prouzročenu posljedicu prometne nesreće. S tim u vezi tri su ključna i minimalno potrebna dokumenta koje policija izrađuje povodom prometne nesreće koja se istražuje, a to su: Zapisnik o očevidu, Skica mjesta događaja, odnosno situacijski plan, te Foto ili video elaborat ili zapis. Oni se isprepliću u svojoj dokaznoj i spoznajnoj vrijednosti i svaki ima svoj značaj usmjeren na to da drugoj osobi, sucu ili vještaku koji nije bio na mjestu događaja plastično i potpuno predoči činjenice potrebne za donošenje suda o prometnoj nesreći.

Abstract (english)

Traffic accidents are a faithful companion to road traffic motorization, so it is certainly argued that road traffic accident research is as old as road traffic. In the case of road accidents and court proceedings, the material evidence collected at the scene of the accident and the testimony of witnesses during the examination are crucial to addressing and analyzing the causes of the road accident. Based on this evidence, the liability of the participants in a car accident is determined. A well-done inspection greatly facilitates the further flow of the cause of a traffic accident and contributes to the resolution of the case. The facts gathered are supporting material for traffic experts to produce findings and opinions on a road accident. Each technical expert report must contain an introductory part, findings, opinion and conclusion. The production of all the documents rests on the gathering of evidence, precise measurement, which requires the fixation of traces and determining the exact location of objects in space, and photographing and transferring images to a specific software tool for the purpose of processing video documentation. The paper gives an overview of how to collect the facts on which a final guilty verdict is based, that is, the liability for the caused consequence of a car accident. In this regard, three key and minimum required documents produced by the police in connection with the traffic accident being investigated are: Eyewitness record, Sketch of the venue or situation plan, and Photo or video study or recording. They are intertwined in their probative and cognitive value, and each has its own significance, aimed at giving the other person, judge or expert who was not at the scene plastic and fully presented the facts necessary to make a judgment about a car accident.
