Abstract

Istraživanja Međunarodne trgovačke komore tijekom dvadesetih godina 20. stoljeća
rezultirale su objavama dviju studija o primjeni trgovačkih termina u različitim
državama. Studije su ukazale na razlike u interpretaciji trgovačkih termina u različitim
državama. Godine 1936., Međunarodna trgovačka komora iz navedenog razloga
objavljuje prvu verziju INCOTERMS-a. Osnovna svrha i cilj INCOTERMS-a je
osigurati prodavateljima i kupcima primjereno reguliranje pravnih i ekonomskih
odnosa u trenutku sklapanja ugovora o kupoprodaji, čime se smanjuje mogućnost
nesporazuma koji bi mogle rezultirati pravnim komplikacijama. Ovim radom su
istražene i analizirane verzije INCOTERMS termina kroz povijest, definirane su
promjene koje su se događale te identificirani su osnovni razlozi za navedene
promjene.

Abstract (english)

The researches the International Chamber of Commerce made during 1920ies
resulted with publications of two studies on the application of commercial terms in
different countries. Studies have shown differences in interpretation of the trade
terms in different countries. Because of that, in1936 the International Chamber of
Commerce published the first version of INCOTERMS. The main goal and purpose of
INCOTERMS is to provide adequate legal and economical relations for sellers and
buyers at the moment when purchase contract is made. In that case, the possibility of
misunderstanding, which could result with legal complications, is diminished. In this
paper, the INCOTERMS versions throughout the history have been researched and
analysed, changes that happened have been defined and the main reasons for those
changes have been cited.
